Learn About
Learn why the ASTM Environmental Site Assessment Standard Practices for the Phase I Site Assessment and the Transaction Screen Process (E1527-05 and E1528-06) were developed, how to use the standards, and how the standards affect the way you do business. You will gain an understanding of the "Innocent Landowner Defense" under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), and why due diligence is necessary.
NEW to the PHASE I CLASS!
The Small Business Liability Relief and Brownfields Revitalization Act of 2002 added two new CERCLA Landowner Liability Protections to the existing Innocent Landowner Defense:
* Bona Fide Prospective Purchaser
*Contiguous Property Owner
The Act also directed USEPA to promulgate a rule containing standards and practices for conducting All Appropriate Inquiries (AAI) for persons seeking to qualify for the three defenses . This new rule was published in the Federal Register on November 1, 2005 and became effective November 1, 2006.
The USEPA has determined that the new ASTM Standard E 1527-05 is in full compliance with the requirements for conducting AAI specified in the recently published EPA rule: Standards for Conducting All Appropriate Inquiries.

About ASTM and Sponsoring Committee E50
ASTM is one of the world's largest voluntary standards development organizations. Recognizing the need for authoritative site assessment standards, ASTM pulled together environmental professionals, real estate and insurance professionals, lawyers, and government representatives. These members of Committee E50 and its Sub. E50.02 on Commercial Real Estate Transactions developed the standards upon which this course is based. For more information on Committee E50 contact Dan Smith at (610) 832-9727 or go to our E50 technical committee page.
ASTM publishes the 82-volume Annual Book of ASTM Standards (available on CD ROM), which contain over 11,000 standards written by 34,000 members on 140 technical committees. These standards are widely used throughout the world as the basis of purchasing and other contracts, codes, laws and regulations.
